Terms of service for Avo

These terms govern access to Avo, its public website, personal workspace, AI features, connected services, and paid plans.

Using Avo

You may use Avo for lawful personal workflows in compliance with these terms and applicable laws.

•Provide accurate account information and keep credentials secure.
•Use the platform responsibly and avoid abusive, fraudulent, or unlawful behavior.
•Respect the rights of other users and third parties.

Accounts and Access

Your Avo account is personal to you and must not be shared or transferred in unauthorized ways.

•You are responsible for activity under your account.
•Avo is for adults. You must be 18 or older to create or hold an Avo account, and by using Avo you confirm that you are at least 18 and legally able to enter these terms.
•If we learn that an account holder is under 18, we may suspend the account and delete it along with its data.
•An adult account holder who saves family or child-profile information is responsible for that information and the related use of Avo. Those profiles are entries inside the adult's own account; they are not accounts a child can hold or sign in to.
•We may suspend or restrict access for security, abuse, or policy violations.
•You must promptly notify us of suspected unauthorized access.

Subscriptions and Billing

Avo offers paid subscription tiers. Plans are billed through Stripe for the billing interval selected at checkout.

•Paid subscriptions (Avo Basic, Avo Plus, Avo Max, Avo Ultra) auto-renew for the selected monthly or annual billing interval until cancelled.
•Plan usage allowances reset monthly unless a specific limit says otherwise. Annual plans bill once per year.
•Current plan limits are shown on the plans page before checkout.
•You may cancel at any time from your account settings. Access continues through the end of your current billing period.
•Video packs are one-time purchases and do not expire.
•Voice Mode is available to every account and uses included minutes or purchased voice credits; accounts may buy one-time voice top-ups.
•Refunds are handled on a case-by-case basis. Contact dino@heyavo.ai for refund requests.
•Prices may change with at least 30 days notice before your next billing cycle.

Paid Plans and Introductory Pricing

Avo is a paid product. There is no free plan and no trial. Eligible new monthly subscribers receive 50% off their first invoice.

•The new-customer monthly offer applies once to the first monthly invoice; later invoices renew at the regular monthly price.
•Annual plans use the annual price shown at checkout, which is approximately 20% below monthly billing, and do not stack with the monthly introductory offer.
•When a paid plan ends, workspace access ends. Subscribe again to continue using Avo.
•Existing content is preserved subject to storage, retention, acceptable-use, and account-deletion policies.
•Generated media (images, videos) are scheduled for deletion from storage 60 days after creation. Generation history and metadata can remain after the media file is removed.
•You may subscribe again at any time; returning subscribers are not eligible for the new-customer introductory discount.

Content and AI Features

You keep any ownership rights you have in the content you upload or create. Uploading content does not transfer ownership to Avo.

•To the extent permitted by law, Avo assigns to you any rights it may have in AI output created for you, including generated images and videos. This does not include other users' content or third-party material. AI output may not be unique or eligible for copyright protection.
•You are responsible for reviewing AI outputs before operational or legal reliance.
•AI features may produce inaccurate, incomplete, or unexpected results. Avo is not liable for decisions made based on AI outputs.
•You are responsible for having the rights, licenses, and permissions required by applicable law to upload, process, edit, and share your content. This includes images used as references for AI generation and content depicting other people.
•You give Avo permission to store, copy, process, and transmit your content as needed to provide the features you request or enable. This includes processing uploads with service providers and delivering content to recipients you choose, as described in our Privacy Policy. This permission does not transfer ownership of your content.

AI Content Acceptable Use

AI image and video generation must be used responsibly. The following uses are prohibited.

•Generating content depicting minors in harmful or inappropriate contexts.
•Creating deepfakes or deceptive impersonations of real people.
•Generating content intended to harass, threaten, or defame individuals.
•Creating content that infringes on third-party intellectual property or copyrights.
•Using generated content for disinformation, fraud, or illegal purposes.
•Note: Some AI models enforce additional restrictions (e.g., face generation may be blocked by the underlying model).

Uploads and Sharing

These terms and our Acceptable Use Policy apply to images, documents, spreadsheets, and other content you use with supported Avo features.

•Review the content, recipients, and any AI-generated changes before sending or sharing. You are responsible for what you choose to send.
•Sending an email delivers copies through your connected email service. Deleting an original file or your Avo account does not recall a sent email or remove copies held by recipients or their service providers.
•Upload processing, saved content, conversation history, and email drafts can have different retention periods. Our Privacy Policy describes how these copies are handled; sending content does not mean every copy is immediately deleted.

Usage Limits

Each subscription tier includes defined usage allowances. These are enforced automatically.

•AI credits, image pack balances, video pack balances, and voice minutes are tracked per account.
•Exceeding a limit may temporarily restrict access to that feature until the allowance resets or additional packs are purchased.
•Usage limits may be adjusted with notice. Changes take effect at the start of your next billing cycle.
•Abuse of the platform (e.g., automated scraping, excessive API calls) may result in account suspension.

Service Changes and Availability

Avo continues to evolve. Features may change as reliability, security, and product scope improve.

•We may update features, pricing, and terms with notice where required.
•Service is provided on an ongoing best-effort basis.
•Maintenance windows and interruptions may occur.

Health, Wellbeing, and AI Limitations

Avo is a personal organizer, not a medical or professional service.

•Avo does not provide medical, mental-health, legal, or financial advice, and nothing it says is a diagnosis, treatment, or professional opinion. Talk to a qualified professional for those.
•Health, mood, and medication features are tools for tracking what you choose to record. Do not rely on them for dosing, emergencies, or clinical decisions.
•If you are in crisis or thinking about harming yourself, contact your local emergency number. In the US you can call or text 988 (Suicide & Crisis Lifeline) or text HOME to 741741.
•Avo is an AI assistant. It can be confidently wrong, and it can misread context — check anything that matters before acting on it.

Disclaimers

What Avo does and does not promise about the service.

•Avo is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
•We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that AI output will be accurate or complete.
•You are responsible for keeping your own copies of anything you cannot afford to lose. Avo is not a backup service.
•Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

Limitation of Liability

The maximum we can be responsible for, and what is excluded.

•To the fullest extent permitted by law, Avo is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption.
•Our total liability for any claim relating to the service is limited to the greater of the amount you paid Avo in the twelve months before the event giving rise to the claim, or one hundred US dollars.
•These limits apply regardless of the legal theory and even if a limited remedy fails of its essential purpose.
•Nothing here limits liability that cannot be limited by law, including for fraud, willful misconduct, or death or personal injury caused by negligence. Some jurisdictions do not allow these limits, so they may not apply to you.

General Terms

Standard provisions that keep the rest of this agreement workable.

•Indemnity: you agree to cover reasonable costs from third-party claims arising out of your content, your use of the service, or your violation of these terms or applicable law.
•Severability: if any provision is held unenforceable, it is limited or removed only to the minimum extent necessary and the rest stays in force.
•No waiver: if we do not enforce a provision, that is not a waiver of our right to enforce it later.
•Entire agreement: these terms, together with the privacy policy, cookie policy, acceptable use policy, and consumer health data policy, are the complete agreement between you and Avo about the service.
•Assignment: you may not assign these terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
•Changes: we may update these terms, and we will post the revised version with an updated date. Material changes get advance notice where required by law. Continuing to use Avo after a change takes effect means you accept the revised terms; if you do not, stop using the service and you may cancel.
•Copyright: if you believe content on Avo infringes your copyright, email legal@heyavo.ai with the material at issue, your contact information, and a statement of good-faith belief.

Termination and Legal Contact

You can stop using Avo at any time. We may terminate or restrict access for material violations or legal requirements.

•Certain obligations survive termination, including legal-compliance obligations and any accrued payment obligations.
•Region-specific consumer protections apply where required by law.
